Who we are and what this covers

The Gaygency ("we," "us") is a marketing and advertising agency based in New York, NY. This policy covers thegaygency.com and its subdomains, the forms on those sites, and the analytics, advertising, and communication tools we run on them.

It does not cover the separate platforms of our clients, the third-party sites we link to, or data we process on behalf of clients as part of a services engagement (that processing is governed by the client agreement). If you are a client, your services agreement or statement of work controls where it differs from this policy.

Information you give us directly

Contact form: first and last name, email, phone (optional), the topic you select, your message, and whether you opted into updates.

Speaking and press requests: name, company or outlet, email, phone (optional), the event type, your notes, and whether you consented to follow-up materials.

Project and discovery-call intake: your name, business name, website, email, phone, and the answers you give about your business, including budget range, approximate revenue, funding sources, goals, services of interest, and scheduling preferences. We save your progress as you move through these forms, before you press submit, so we can help if a submission fails partway and so a partially completed inquiry can still be followed up. If you would rather we delete a partial submission, ask and we will.

Talent Network: name, pronouns (optional), email, phone (optional), location, bio, expertise, portfolio links and uploads, and any demographic information you volunteer, including information about LGBTQ+ identity. That information is always optional, is used only for casting, staffing, and representation purposes, and is never sold.

Careers: the information in your application and anything you upload with it.

Newsletter: your email address and the consent you gave when subscribing.

Information collected automatically

When you visit the site we and our service providers collect device and usage data: IP address, general location derived from it, browser and device type, pages viewed, referring pages, and interactions with the site. Form submissions also record the submitting IP address, which we use for spam prevention and rate limiting.

Subject to your cookie consent choices, we use: Google Analytics 4 (site usage and performance), Google Ads conversion tracking, the Meta Pixel (ad measurement and audience building for Facebook and Instagram), and AudienceLab, a visitor-identification and audience-building tool that can associate site visits with identity data to support our marketing. Our consent banner (Termly) records the consent choices you make so we can honor and prove them. We honor the Global Privacy Control (GPC) browser signal as an opt-out of targeted-advertising cookies.

How we use information

To respond to your messages, requests, and applications; to schedule and run discovery calls, including processing the five-dollar reservation fee; to evaluate project fit and prepare for conversations you asked for; to run the Talent Network and staff projects; to send transactional emails such as confirmations, receipts, and scheduling notices; to send marketing updates only where you opted in, with unsubscribe honored immediately; to measure and improve the site and our campaigns; to prevent spam, fraud, and abuse; and to meet legal, accounting, and tax obligations.

We do not use the contents of your messages to train AI models, and we do not sell personal information for money.

Who we share information with

Service providers that run our infrastructure, under contracts limiting their use of your data: Vercel (website hosting), Supabase (databases), Stripe (payment processing — card details go to Stripe directly and never touch our servers), Resend (email delivery), Slack (internal alerts when forms are submitted), Google (analytics and ads), Meta (pixel-based measurement and audiences), AudienceLab (visitor identification and audiences), and Termly (consent management).

Advertising tools: the Google, Meta, and AudienceLab tools described above involve disclosing identifiers and site activity to those companies for advertising purposes. Under some state laws, including the California Consumer Privacy Act as amended, that can count as "sharing" or a "sale" of personal information. You can opt out at any time through the cookie consent banner, via the Global Privacy Control signal, or by contacting us; see section 08.

We may also disclose information when the law requires it, to protect our rights or the safety of others, or as part of a business transaction such as a merger, in which case this policy continues to apply to the transferred data. We never sell or share the optional demographic information collected in the Talent Network.

How long we keep it

Contact and speaking messages: as long as needed to handle the conversation, then archived with our business records. Intake and booking records: for the life of the relationship they support and the retention period our accounting and legal obligations require. Partial form drafts: reviewed periodically and deleted when they are no longer useful for follow-up. Talent Network profiles: until you ask to be removed. Marketing lists: until you unsubscribe. Analytics data: per the retention settings of each tool, which we keep at or below the tool's defaults.

When we no longer need personal information, we delete it or de-identify it.

Security

Data is encrypted in transit (TLS) and at rest with our storage providers. Access to systems holding personal information is limited to people who need it, behind authentication. Payment card data is handled entirely by Stripe, a PCI-DSS Level 1 processor. Our public forms carry layered anti-bot protections.

No internet service can promise perfect security. If a breach affecting your personal information occurs, we will notify you and regulators as the law requires.

Your rights and choices

Depending on where you live (including California, Colorado, Connecticut, Virginia, Utah, and the EEA/UK), you may have the right to: know and access the personal information we hold about you; correct it; delete it; receive a portable copy; opt out of targeted advertising, "sale," or "sharing"; limit use of sensitive personal information; and not be discriminated against for exercising any of these rights.

To exercise any right, use the contact form at thegaygency.com/contact and tell us what you want in the message. We verify requests against the information we hold, respond within the time the applicable law sets (45 days in California, extendable once), and you may use an authorized agent. If we refuse a request, you can appeal by replying to our decision and someone different will review it.

Independent of location: every marketing email we send has a working unsubscribe link, and cookie choices can be changed at any time via the consent banner. We honor Global Privacy Control signals as an opt-out of targeted-advertising cookies.

Children

The site is a business-to-business service and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.

Where data lives and legal bases

We are a United States company and process data in the United States. If you visit from outside the U.S., your information will be transferred to and processed in the U.S., where privacy laws may differ from your jurisdiction's.

Where GDPR applies, our legal bases are: performance of a contract or steps you request before one (forms, bookings), consent (marketing emails, non-essential cookies, optional demographic data), and legitimate interests (site security, spam prevention, improving our services) balanced against your rights. You may withdraw consent at any time without affecting prior processing.

Changes and contact

We will post any changes to this policy here and update the "Last updated" date; material changes get a notice on the site. Continued use of the site after a change means the updated policy applies.
