Gender X

Gender X refers to an 'X' sex or gender marker on identity documents for people who are non-binary, intersex, or otherwise not exclusively male or female. In 2021 the U.S. State Department began offering X on passports, defining it as 'unspecified or another gender identity,' and availability on state IDs varies. Access has since narrowed at the federal level. In 2025 an executive order directed the State Department to stop issuing passports with the X marker and to record only sex assigned at birth, a policy being fought in court in cases such as Orr v. Trump. Existing X passports remain valid until they expire. Several other countries continue to offer an X option.
